Learned advocate appearing for the petitioner submits that the petitioner herein is not only a proper party, but a necessary party. Considering the pendency of the Special Civil Suit no. 424 of 2006, the court ought to have allowed impleadment of the party in Regular Civil Suit no. 597 of of 2011.
Let notice be issued to the respondents returnable on 9th July 2012.
