(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail on the ground that he wants to attend the post death ceremony of his aunty who has died on 13.01.2012.
Pursuant to the earlier order passed by this Court on 17.02.2012, the learned APP based on the report of the Superintendent of Police, Amreli, has confirmed that the ground mentioned in the application is genuine. Considering the facts and circumstances, the discretion deserves to be exercised.
Under these circumstances, the applicant-convict be released on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs.5000 and one surety of like amount. It is further directed that upon expiry of the said period, he shall surrender with the jail authority in time.
Application allowed to the aforesaid extent. Rule made absolute accordingly.
