Petitioner was initially employed in the District Rural Development Agency, Ghazipur. His services have subsequently been absorbed in the department of Rural Development of the State of Uttar Pradesh. After his retirement the petitioner has not been paid gratuity amount, leave encashment dues, arrears of introduction of 6th and 7th Pay Commission Report and also pension have not been released so far. In respect of such grievance, the petitioner has made various representations but the same have not been considered.
Learned Standing Counsel submits that grievance of the petitioner shall be examined by the authority concerned, in accordance with law, at the first instance.
Considering the facts and circumstances, noticed above, this writ petition stands disposed of by permitting the petitioner to represent his grievance before the respondent no. 3, alongwith certified copy of this order within three weeks from today. Petitioner shall be at liberty to annex all materials in support of his claim. The authority concerned shall have the petitioner's grievance examined and would pass an appropriate order, as may be required in law, within a period of three months thereafter. Any benefit which is found due and payable to the petitioner, would be released within a further period of six weeks, thereafter.
