Heard learned counsel for the petitioners. Learned Standing counsel for the respondents.
The land of the petitioners was acquired in 1960 and it had vested in the State of U.P. On a question being raised in the Assembly in the year 1992 a letter was issued stating that 249.92 acers of the acquired land is now not needed and therefore the Government is thinking of de- notifying the same.
The petitioners have filed this writ petition for a direction that the land be returned to them pursuant to the above letter dated 13th November 1992.
First of all, the petitioners are approaching this Court after a long gap of time.There is no explanation why they are coming so late. Moreover, the land vested in the State of U.P., can not be de-notified. Learned counsel for both the parties are unable to show us any provision by which the land of the petitioners was vested in the State of U.P., can be abandoned and returned to the original tenure-holders.
At this stage, learned counsel for the petitioners submits that he may permitted to withdraw the writ petition.
In view of the above, the writ petition is dismissed as withdrawn and the observation made herein-above would not come in way of the petitioners, if they take some other appropriate remedy in accordance with law.
