The petitioner is original plaintiff and the respondents herein are original defendants in Regular Civil Suit No. 150 of 2011 filed by the petitioner in the Court of learned Principal Senior Civil Judge, Surat for declaration and permanent injunction.
During the course of hearing, learned advocate fairly submits that at this stage the petitioners requests for expeditious hearing of application for injunction and reiterates that Exh. 44 application is long concluded. However, as averred respondent No. 7 is carrying on construction on the property in question which is coming up with unimaginable speed. In petition under Article 227 of the Constitution before this Court at this stage, he does not insist for any relief and hence, none of the factual aspects are required to be gone into. It will be sufficient for this Court to direct the trial court to expeditiously hear application for injunction and dispose of the same as early as possible.
The matter stands disposed of in the terms above.
