COMMON ORDER:
The petitioners in these two cases approached this Court aggrieved by the alleged action of the respondent authorities viz., the District Collector, R.R. District; the Mandal Revenue Officer, Balanagar Mandal, R.R. District; and the Circle Inspector of Police, Bowenpally Police Station, R.R. District, in interfering with their building construction activity in the subject plots in L.B. Nagar, Bowenpally, R.R. District.
2. Interim orders were passed in both the writ petitions in October 2004 to the effect that if the petitioners proceeded with the constructions in accordance with the sanctioned plans granted by the Kukatpally Municipality, the respondent authorities should not interfere with the same. During the pendency of the writ petitions, several persons got impleaded as respondents in these two writ petitions and claimed independent rights in respect of the subject lands. It is now stated by the learned Government Pleader for Revenue that the State also has an interest in the subject lands. He further states that no construction as such has been put up in the subject lands and only small rooms were constructed. This aspect of the matter has not been denied by the learned counsel for the petitioners. As the scope of these writ petitions is limited to the alleged interference by the authorities with the construction activity of the petitioners in the subject lands, this Court sees no reason to enlarge the same so as to decide the issues now sought to be raised by the unofficial respondents as well as the State. It is for them to establish the same before the appropriate forum in accordance with law. Insofar as the actual issue involved is concerned, it is made clear that in the event the petitioners have valid building sanctions from the competent authority, it would be open to them to make constructions strictly in accordance therewith and if they do so, there shall be no interference from the respondent authorities.
3. Subject to the above observations, the writ petitions are closed. Pending miscellaneous petitions, if any, in these two writ petitions shall stand closed in consequence. No order as to costs.
