JUDGMENT / ORDER

Challenge in this petition is to the F.I.R. registered at case crime no. 25 of 2010 under sections 420, 468, 471, 120-B I.P.C., section 3/7 of Essential Commodities Act, 1955, section 15, 16, 22 of the U.P. Sugarcane (Regulations of Supply and Purchase) Act, 1953, Section 6(1) (A) (F) of the Sugarcane Control Order, 1966 and section 5(1)(2) (3) (6) of the U.P. Sugarcane (Supply and Purchase) Order, 1954 police station Thana Bhawan District Muzaffarnagar.
We have heard learned counsel for the petitioners, learned A.G.A. for the State and Shri Ravindra Singh, learned counsel for the Cane Development Societies Ltd.
The issues canvassed before us are the self same issues which have been elaborately argued in Criminal Writ Petition No. 1072 of 2010 in which while granting interim order staying the arrest of the petitioners, the petition has been posted for final hearing on 8.3.2010 alongwith other petitions involving similar issues. For detailed order, see order dated 25.1.2010 passed in writ petition no. 1072 of 2010.
Learned A.G.A. may file counter affidavit within four weeks. Learned counsel for the Cane Development Society may also file counter affidavit within the same period. Rejoinder affidavit, if any, may be filed within one week next thereafter. List this matter on 8.3.2010 alongwith writ petition no. 1072 of 2010.
Till then the arrest of the petitioners namely, Parminder Arya and Ashok Kumar who are wanted in the case, as aforesaid, shall remain stayed. Order Date :- 28.1.2010 o.k.
