Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record of the anticipatory bail application.
The present anticipatory bail application has been filed by the applicants Parmendar Pandey, Arvind Pandey, Dharm Lal Pandey and Tirath Pandey with a prayer to enlarge them on anticipatory bail in Coplaint Case No. 31 of 2019, under Sections 323, 354, 504, 506 I.P.C. and Sections 3(1)Da & Dha Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station Khutahan, District Jaunpur.
Learned A.G.A. points out that the case also pertains to an offence under the SC/ST Act and as per provisions of SC/ST Act, the anticipatory bail is not applicable to such offence.
In view of above, I do not find any good ground to enlarge the applicants on anticipatory bail and the present anticipatory bail application is liable to be rejected.
Accordingly, the anticipatory bail application is rejected.
However, it is directed that if the applicants surrender and give regular bail application before the court below, the same shall be disposed of expeditiously, preferably on the same day, in accordance with law.
