Heard learned counsel for the petitioners.
In view of the order proposed to be passed, notices need not go to the private respondents.
The petitioner is before this Court for a direction to Civil Judge (S.D.), Budaun/respondent no.1 to expedite the application no.5C in Original Suit No.174 of 2019 (Shri Parmatama Saran (since deceased) and another Vs. Venkatesh Vaish and another) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (S.D.), Budaun/respondent no.1 to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of three months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
