JUDGMENT / ORDER

1. By way of this petition, the petitioner has challenged the judgment and order dated 30.07.2011, passed by the Presiding Officer, Labour Court, Mehsana, in Reference (LCM) No. 718 of 2008(old No. 68 of 2005), whereby the Reference Court has dismissed the said Reference.
2. The brief facts leading to filing of this appeal are that present petitioner was working in the establishment of respondent No.1 as Chokidar on daily wages from 21.11.1980 to 25.5.1982. The services of the petitioner was terminated on 25.5.1982. Therefore the petitioner has raised an Industrial dispute. Thereafter, the matter is refereed to the Labour Court, Junagadh, for its adjudication, which has been registered as Reference (LCM) No. 718 of 2008.
2.1. The Reference Court after hearing learned advocates for both the parties and after recording the evidence decided the said reference vide judgement and order dated 30.07.2011, dismissed the said Reference, against which the present petition is filed by the petitioner-original opponent.
3. Learned counsel for the petitioner contended that the Reference Court erred in passing the impugned judgment and award. The Reference Court failed to appreciate the material on record in its true perspective. Therefore, he has prayed to allow the present petition.
4. Heard learned counsel for the parties and perused the material on record. I have gone through the impugned award of the Reference Court and I find that the Reference Court after considering the evidence on record has passed the impugned judgement and award. Further the Reference Court after considering the cross-objection of the petitioner has dismissed the Reference. I am in complete agreement with the reasonings given by and the conclusion arrived at by the Reference Court and hence, I find no reasons to entertain the present petition.
5. In the result, this appeal is dismissed. No order as to costs.
