Learned Advocate Ms.Rina Kanani for learned Advocate Mr.P.H.Pathak for the petitioner drew the attention of the Court to the fact that for Respondent No.1 brother Justice Paresh Upadhyay was appearing before elevation to this Court.

The Registry is directed to issue notice to Respondent No.1 intimating the said fact and asking him to make necessary alternative arrangement to get his case presented before the Court. The Registry may mention that the matter is kept on 25th January, 2013.
