JUDGMENT / ORDER

1. The present second appeal u/s.100 of the Code of Civil Procedure has been preferred by the appellants herein - original defendants to quash and set aside the impugned judgement and decree passed by learned Joint Civil Judge (J.D.), Mahesana in Regular Civil Suit No.212 of 1983 confirmed by learned Appellate Court i.e. learned Extra Assistant Judge, Mahesana in Regular Civil Appeal No.52 of 1987, by which, both the Courts below have dismissed the suit preferred by the original plaintiff.
2. Today when the present second appeal is taken up for final hearing, Ms.Maya Desai, learned advocate for Mr.M.D.Pandya, learned advocate appearing on behalf of the respondent herein has stated at the bar that the matter is settled between the parties in the Lok Adalat. Hence, no cause survive in the present second appeal. Considering the above, the present second appeal is dismissed as having been infructuous as it is reported that the parties have settled the dispute amicably in the Lok Adalat. No costs.
