Heard Sri Subhash Chandra Pandey, learned counsel for the applicants, Sri Amit Sinha, learned A.G.A. for the State- respondents and Sri Rajesh Kumar Mishra, learned counsel for the complainant.
This application under Section 482 Cr.P.C. has been filed by the applicants seeking quashment of NBW dated 25.05.2019 issued by A.C.J.M., Court No. 2 Rampur in Case No. 18 of 2019 arising out of case crime no. 223 of 2017, under Sections 147, 149, 353, 332, 504, 506, 323 of I.P.C., P.S. Shahabad, District Rampur.
Learned counsel for the applicants submits that without issuing bailable warrant, trial court has directly issued non bailable warrant against the applicants. He submits that purpose of filing this petition would be served if direction is issued to the trial court to consider the application to be filed by the applicants within two weeks and till then some protective umbrella be granted to the applicants.
Learned counsel for the State and learned counsel for the complainant have no objection to this proposition.
The application is disposed of permitting the applicants to file appropriate application before the court below within two weeks.
Till two weeks from today, no coercive steps shall be taken against the applicants.
