Learned counsel for the petitioner is present.
Learned A.G.A for the State submitted status / compliance report dated 20.07.2016, which is taken on record. In the report it has been submitted that Muzrim Ansari, Phoolmati and Gaya Shanker are absconding, hence the Investigating Officer has applied for non-bailable warrant against them on 10.05.2016. Raids are also being made and advertisements regarding corpus are also published in Daily Newspaper as "Swatantra Bharat". It is also submitted that so far no clue regarding the corpus could be obtained.
Learned counsel for the petitioner submitted that investigation is not being done properly and sincere steps are also not being made. The case is pending for the last two years. The corpus was lost in the year 2014 and many compliance reports about the whereabouts of corpus submitted but whereabouts is still unknown and from this fact, it can very well be said that whereabouts of corpus is not known to the police. In the circumstances, the petitioner is directed to give information regarding the illegal detention of the corpus and also to give information in whose possession she might be. This is not jurisdiction of High Court to get the investigation done properly, in case proper investigation is not being made then remedy lies elsewhere, and petitioners can very well move to the higher authority.
In the circumstances, if no concrete information is given by the petitioner by the next date fixed then appropriate order would be passed.
Further compliance report / status report is required by the State on the next date of listing. State is directed to make efforts for tracing out the corpus, in case corpus is not produced before this Court on the next date fixed, the I.O. of the case will remain present personally.
