The petitioner submitted Ext.P1 application before the first respondent Chief Conservator of Forests for acquiring an elephant from other states like Arunachal Pradesh/Assam. This was rejected as per Ext.P2. Challenging Ext.P2 this writ petition is filed.

This Court in Ext.P5 judgment held that if the petitioner is acquiring the elephant from outside the State, he does not require any permission from the State where he intends to transfer the elephant brought from outside State. If the petitioner brings the elephant from outside the State, he has to intimate the Chief Wild Life Warden or Authorised Officer within whose jurisdiction transfer or transport is effected in terms of Section 43(2) of the Wild Life (Protection) Act, 1972. If the petitioner wants to obtain ownership from outside the State from any person, a WP(C).No.27680/2014-H.
2 certificate of ownership has to be obtained from that State from where he intends to obtain ownership of the elephant. Therefore, with liberty to the petitioner to approach such authority for acquiring the elephant from outside the State, Ext.P2 is set aside.
This writ petition is disposed of as above.
