Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer, Neredmet, Cyberabad to enlarge the petitioner on bail in the event of her arrest in Crime No. 17 of 2014 of P.S. Neredmet, Cyberabad, on such terms and conditions.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri M.W.R. Jayakar, Advocate for the Petitioner and of the Public Prosecutor on behalf of Respondent- State, the Court made the following.
ORDER:-
“This Criminal Petition is filed by the petitioner – accused No.2, under Section 438 Cr.P.C, seeking release in the event of her arrest in connection with Crime No.17 of 2014 of Neredmet Police Station, Cyberabad.
A private complaint, filed under Section 200 Cr.P.C, was referred to police under Section 156 (3) Cr.P.C. and the same came to be registered for the offences punishable under Sections 379, 384, 420 and 506 IPC.
Facts, in issue, are that the petitioner is the wife of A.1 and the informant is the mother of A.1. The averments in the complaint would disclose that, on 27.08.2012, A.1 and A.2 entered into the house of the informant and forcibly took away two tulas of gold chain from the husband of the informant, who was a paralysis patient. When the informant interfered, A.1 is alleged to have pushed her down and attempted to crush her neck. Thereafter, A.2 is alleged to have abused the informant in filthy language and also threatened her with dire consequences. Basing on these allegations, the above crime came to be registered.

The material on record would indicate existence of some disputes between the parties who are very closely related to each other. A.1 was arrested and released on bail. Having regard to the facts and circumstances of the case, and since the petitioner is the wife of A.1, I am inclined to grant anticipatory bail to the petitioner.
Accordingly, the Criminal Petition is allowed. The petitioner is directed to surrender before the Station House Officer, Neredmet Police Station, Cyberabad within a period of ten days from today and on such surrender, she shall be released on bail on her executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a likesum to the satisfaction of the same Station House Officer.”
