It is contended that respondent No. 5-M/s Vinod Kumar Rai through its Proprietor, obtained the work of contract by suppressing material fact and when the fact came to the knowledge of the petitioner, who was also unsuccessful bidder, filed his objection before respondent No.2-Chief Engineer, Circle Varanasi, Public Works Department, Varanasi on 6.2.2018 and subsequent reminder was also sent, but till date no decision was taken in the matter.
Learned Standing Counsel fairly submits that in case any such objection filed by the petitioner is pending, the decision thereon shall be taken by the appropriate authority, expeditiously.
Considering the facts and circumstances, we dispose of this petition by commanding the respondent No. 2-Chief Engineer, Circle Varanasi, Public Works Department, Varanasi to consider and decide the objection filed by the petitioner on 6.2.2018, in accordance with law, by reasoned speaking order within a period of four weeks from the date of production of certified copy of this order before him.
Needless to say that before taking any decision, respondent No. 2 shall be at liberty to give appropriate notice and shall provide an opportunity of hearing to all the concerned parties.
