JUDGMENT / ORDER

Heard learned counsel for the applicant and learned A.G.A. for the State. The accused applicant Parikh Lal is involved and detained in S.T. No. 45 of 2008, case crime no. 403 of 2007, under Sections 147, 148, 149, 302, 34, 307 I.P.C. and Section 25 Arms Act, from Police Station Hargaon, District Sitapur and he has applied for bail.
The trial court, vide order of this Court dated 4.11.2009, was directed to furnish the latest progress/ current status of the trial pending against the accused applicant but the same has not been received so far. The Sessions Trial is pending against the accused applicant since 2008. Admittedly, the trial is in progress. Learned counsel for the accused applicant during the course of arguments instead of pressing the bail application on merit, requested that the bail application of the accused applicant be disposed of finally with the direction to the trial court concerned to conclude the sessions trial pending against the accused applicant within the given time schedule. In view of the submissions of the learned counsel for the accused applicant, the bail application is finally disposed of with the observation that the trial court concerned will conclude the sessions trial pending against the accused applicant within a period of four months from the date, certified copy of this order is produced before it.
