ORDER:
This Writ Petition is filed for the following substantive relief:
“ to issue a Writ, in the nature of Writ of Mandamus or any other appropriate Writ, direction or order declaring the action of the respondents interfering in bio-products, which contains which contains SEA WEEDS (Cold Water Kelp Extract) AMINO ACIDS, ASCORBIC ACIDS (VITAMIN-C), HUMIC ACIDS, ADEQUATE QUANTITIES OF MYOINSITOL, THIAMINE (VITAMIN-B1) ALPHA-TOCOPHEROL (Vitamin-E), PLANT EXTRACTS & ALKALOIDS AMINO ACIDS, GROWTH PROMOTERS, SEA WEEDS, PLANT EXTRACTS AND ALKALOIDS, for marketing sale and distribution, by Memo No.PPII (1)/2085, dated: 21.01.2006 and the letter No. PP.II (1)2085/2005, dated: 21.01.2006 as illegal, arbitrary unconstitutional and without jurisdiction and further direct the respondents not to interfere in any manner in the marketing sale and distribution of the petitioner's bio-products, including from the licensed premises of the dealers/stockiest under the Insecticides Act, 1968 and the Fertilizer Control (Order) Act, 195.”
After arguing the case, Sri G.Rajeshwar Reddy, learned counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition with liberty to his client to file a fresh Writ Petition with material particulars relating to establishment of the Bio-products Unit by it and the material in support thereof.
The Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.39446 of 2014 filed by the petitioner for interim relief is dismissed as infructuous.
