(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) This application is filed seeking condonation of delay of 33 days in filing MCA for permission to pursue the appeal in pauperism. It appears that the First Appeal as well as application for pauper, both came to be dismissed for non-removal of office objections.
In that view of the matter, this Civil Application also does not survive. Additionally we find that the Claims Tribunal has awarded a sum of Rs.3,80,800/-. The applicants therefore, cannot be said to be persons not in possession of sufficient means to pay Court fees. Even if First Appeal was to be restored, the applicants can seek sufficient time for paying the Court fees. Under the circumstances, Civil Application is disposed of.
