JUDGMENT / ORDER

Petitioners have approached this Court complaining of the inaction on the part of the 1st respondent in completing the proceedings in relation to the application filed by the petitioners for occupancy certificate and for numbering the buildings. According to the petitioners, they had constructed building as per Ext. P7 building permit. There was some issue regarding violation of the provisions of the Municipality Building Rules. According to them, they had rectified the defects pointed out and had submitted fresh application. But, still, the application was not considered on the ground that vigilance enquiry was pending. 2. A statement is filed by the learned Government Pleader as per directions issued by this Court inter alia stating that the vigilance enquiry revealed that there was no lapse on the part of the officers concerned.
3. Having regard to the aforesaid statement, I do not think that there is any impediment on the part of the 1st respondent to consider Ext. P17 application. Though the 1st respondent has filed a counter affidavit, since the relief sought for is only for a direction to consider Ext. P17 application, there is no necessity to consider the matter on merits.

Accordingly, there will be a direction to the 1st respondent to consider Ext. P17 in accordance with law, which shall be done within one month from the date of receipt of a copy of this judgment.
