The counsel for the petitioner is permitted to correct the prayer clause.
Heard Sri D.C. Dwivedi, for the petitioner and Sumit Kakkar, for the respondent-bank The writ petition has been filed for quashing the order dated 2.2.2018 passed by Chief Metropolitan Magistrate, Kanpur Nagar fixing a date in the proceeding under Section 14 of the Act. Since it is interim stage as such writ petition is not maintainable.
The counsel for the respondents further informs that the petitioner has already field an application under Section 17 of Secularization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 before Debt Recovery Tribunal in which 18.4.2018 has been fixed. Thus, this relief cannot be granted.
So far as the request of the petitioner for supply of statement of account of relating to loan amount of the petitioner is concerned, the writ petition is disposed of directing Branch Manager, United Bank of India, Vikas Nagar, Kanpur Nagar to supply statement of account to the petitioner within a period of 15 days from the date of production of a certified copy of this order before him.
