Heard Sri Balram Mishra, learned counsel for the petitioner, Sri Pankaj Kumar Gupta, learned counsel for respondent no. 4 and learned Standing Counsel for the State-respondents.
The sole grievance of the petitioner is that despite the applications moved for removal of encroachments over plot No. 97 of Village Madraha, Post Bakhira, Tehsil Khalilabad, District Sant Kabir Nagar, the encroachments were not being removed.
Learned Standing Counsel submitted that the petitioner has an efficacious alternative remedy of filing of an application/case under Sections 25/26/67 of the U.P. Revenue Code, 2006.
Under such circumstances, without going into the merits of the case, it is being directed that if the petitioner files an application within a period of 15 days from today, for removal of encroachments, then the application shall be treated as an application under Section 67 of the U.P. Revenue Code, 2006 and the same shall be decided within a period of 90 days thereafter, if there is no legal impediment.
With these observations, the writ petition is disposed of.
