Heard learned counsel for the petitioner.
The present petition has been filed for the direction upon the Civil Judge (Senior Division), Ballia to consider and decide the original suit no.264 of 2006 (Madan Prasad and others Vs. Om Prakash and others) within a stipulated period.
The case of the petitioner is that the suit has been filed for permanent injunction restraining the opposite party not to interfere in the peaceful possession of the land of the petitioner.
Petitioner, further, stated that date was fixed on several occasions but till date, suit has not been decided. In support thereof, he also annexed the order sheet.
Considering the facts of the case, the petition is disposed of with a direction to the Court below to decide the suit expeditiously, preferably if possible within a period of one year from the date of production of certified copy of the order without granting any unnecessary adjournments to either of the parties.
