Learned counsel for the petitioner as well as Sri Shashi Prakash Giri learned counsel for the respondent no. 4 and the State counsel are present.
Sub-Inspector Sri Vinod Kumar posted at P.S.- Bahedi, District- Bareilly is also personally present in the Court with respondent no. 4 Vinod Kumar Saxena who is in his custody.
S.I. Sri Vinod Kumar has stated before this Court that there is no boy of the name of Paras in village Jaju Nagar lying in the circle of P.S.- Bahedi of District- Bareilly. He has also stated that no son of the name of Paras had ever been born to Vinod Kumar Saxena (respondent no.4) according to his information.
S.I. Sri Vinod Kumar has further stated that a lady of the name of Smt. Jyoti Saxena had met him and she told that she was the wife of respondent no. 4 Vinod Kumar Saxena; that she had also given her affidavit having photograph thereon and also told that now she had entered into matrimonial alliance with some other person, namely, Nafees Siddiquee/Nafeesurrahman; that she had also told that no boy of the name of Paras had born to her from Vinod Kumar Saxena(respondent no.4); that at this time the wife of Vinod Kumar Saxena is another lady of the name of Uttra Saxena from whom a girl, namely, Kriti Saxena was born.
Learned AGA has sought time to file affidavit of Smt. Jyoti Saxena which was given by her to S.I. Vinod Kumar.
On the next date the petitioner Smt. Jyoti Prakash shall remain present in person before the Court.
S.I. Sri Vinod Kumar shall take back the respondent no. 4 Vinod Kumar Saxena and shall produce him before the C.J.M. concerned who shall release him on his furnishing bail bonds to his satisfaction and on giving undertaking by him to remain present in person before the Court on the date fixed.
List this matter on 15.3.2016.
A copy of this order be sent to the S.S.P. concered through A.G.A. for having a close watch on this matter and for submitting his report on his personal affidavit after making proper enquiry to the effect as to whether any boy of the name of Paras aged about 8 years was ever born to Vinod Kumar Saxena(respondent no. 4) from his wife Smt. Jyoti Prakash through whom this writ petition has been filed by Paras.
On the said date S.I. Vinod Kumar shall also remain present in person before the Court.
A copy of this order be given to learned AGA for compliance of the order.
