Heard Sri Ramesh Kumar Pandey, learned counsel for the applicant, Sri Satish Kumar Singh, learned counsel for the State and perused the record.
The anticipatory bail application under Section 438 Cr.P.C. has been filed by the applicant Paras Nath Yadav, seeking anticipatory bail, in the event of arrest in Case Crime No.129 of 2021, under Sections 419, 420, 467, 468, 471 IPC and 3, 5A, 5B and 8 The U.P. Prevention of Cow Slaughter Act, u/s 11 of Prevention of Cruelty to Animal AAct, 1960, P.S. Pannuganj, District Sonbhadra.
Learned counsel for the applicant argued that as the applicant could not fulfill the illegal demand of the police personnel, he has been falsely implicated in the present case. It is alleged that he had changed the registration plate of the vehicle in question and animals were being transported on the said vehicles which was apprehended and then chassis number which was inquired and found that the registration number of the vehicle is different as that of the number plate which is affixed on it. The applicant is the owner of the said vehicle. The applicants have no criminal history as stated in para no.21 of the affidavit.
Per contra learned counsel for the State vehemently opposed the prayer for anticipatory bail. The allegation against the applicant are serious in nature. The present case is a case in which the applicant is involved.
After having heard the learned counsel for the parties, it is evident that the allegation against the applicant are serious in nature.
The present anticipatory bail application is rejected.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the applicant(s) along with a self attested identity proof of the said person(s) (preferably Aadhar Card) mentioning the mobile number(s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
