Heard Sri Rajiv Kumar Singh, learned counsel for opposite party no. 2 and learned Additional Government Advocate for the State.
From perusal of the entire records, I do not find it to be fit case to interfere with the charge sheet and the prosecution at this stage. It is always open for the applicant to contest the matter as mere filing of the charge sheet does not amount to conviction and the applicant can lead evidence at this stage of the trial or even at the stage of framing of charges, can argue that no charge is made out.
The applicant is accordingly consigned to records. Interim order dated 21.12.2018 is hereby discharged. Order Date :- 27.2.2019 Sanjeev
