1. Mr.
Jayprakash Umot, learned advocate has appeared and submitted that he has received instruction to appear on behalf of respondent No.2 however he has not entered his appearance.
2. Mr.
Purohit, learned advocate for the petitioner has appeared and tendered affidavit dated 27.12.2012 on behalf respondent No.2 i.e. original complainant.
3. It is jointly submitted by learned advocate for petitioner and learned advocate for respondent that the matrimonial dispute between the petitioner and the respondent No.2 is amicably settled and therefore the chargesheet / complaint may be quashed. It is also submitted that until chargesheet / compliant is quashed the proceedings in connection with the impugned FIR being I-C.R. No.280 of 2012 registered with Vejalpur Police Station, Ahmedabad may be stayed.
4. Having regard to the said request and submission, below mentioned order is passed:-
Rule returnable on 31.1.2013. Mr. Kodekar, learned APP waives service of Notice of Rule on behalf of respondent No.1. Until then ad-interim relief in terms of paragraph No.12(b) is granted.
