… Respondents THE HON’BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE NO.95 OF 2014 O R D E R This contempt case was instituted alleging disobedience to the order dated 10.09.2013 passed by this Court in WPMP No.32341 of 2013 in W.P.No.26170 of 2013. By the said order, this Court directed status quo as to possession to be maintained with regard to the property which was the subject matter of the G.O. impugned in the writ petition.
The allegation of the petitioner before this Court is that the second respondent herein was interfering with his possession over the said property in contravention of the order passed by this Court.
The second respondent however filed a counter-affidavit wherein he stated that he had never interfered with the possession of the petitioner at any point of time. No reply-affidavit is filed rebutting this averment. Learned counsel appearing for the petitioner also does not dispute the said averment made in the counter-affidavit.
In the light of the said statement of the second respondent, this contempt case is closed. C.A.No.58 of 2014 shall stand closed in the light of this final order. No order as to costs.
