1. Learned counsel for the petitioner is permitted to implead State of U.P. through its Secretary, Ministry of Labour, U.P., Lucknow as respondent no. 5, during the course of the day.
2. Heard learned counsel for the parties.
3. The petitioner discloses himself to be a civil contractor registered with Nagar Palika Parishad, Mathura. He claims eligibility for exemption under Section 17 of the Act no. 19 of 1952. At present, the petitioner appears to have filed an application seeking such exemption to the respondent no.4.
4. Sri Jagdish Pathak, learned counsel for the respondent no. 4 states that even if such exemption were to be claimed, the proper forum for the same would be State Government by virtue of Section 17 of the aforesaid Act.
5. The objection raised is well-founded. In view of the above, the present petition is disposed of with the direction that in case the petitioner files a proper application for grant of exemption in accordance with law before the appropriate government, it is expected that the same may be heard and decided by a reasoned and speaking order, as expeditiously as possible, preferably within a period of six months from the date of filing such application along with certified copy of this order.
