PRAYING TO ENLARGE THE PETITIONERS ON BAIL IN THE EVENT OF THEIR ARREST IN CRIME NO.120/2017 OF HOSPET RURAL POLICE STATION, BALLARI DISTRICT FOR THE OFFENCES P/U/Ss.468, 471, 420, 447, 504, 506 R/W. 34 OF IPC.
THIS CRIMINAL PETITION COMING ON FOR ORDERS, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Case is registered in Crime No.120/2017 on the complaint lodged by one Dasanal Hanumanthappa for the offences punishable under Sections 447, 420, 468, 471, 504 and 506 read with Section 34 of IPC.
2. The case of the prosecution is that the accused persons have cheated the complainant in respect of the property bearing Door Nos.1273A, 1274A and 1275A with Assessment Nos. 1273A, 1274A and 1275A near Sai Baba Temple, T.B.Dam Road at Ward No.31, Hosapete. The accused hatched a plan to knock off the above mentioned properties and in this connection, they had misused the confidential matters of the concerned.
3. Learned High Court Govt. Pleader opposes the application.
4. The apprehension of the prosecution could be set at rest by imposing appropriate conditions. Hence, I pass the following order:
The petition is allowed. The petitioners are ordered to be released on bail in the event of their arrest in connection with Cr.No.120/2017 for the offences punishable under Sections 447, 420, 468, 471, 504 and 506 read with Section 34 of IPC subject to the following conditions:
i) The petitioners shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh Only) each with one surety each for the like sum to the satisfaction of the Investigating Officer.
ii) The petitioners shall appear before the Investigating Officer on all the future hearing dates and as and when required for the purpose of investigation.
