On 13.12.2017, following order was passed:-
"It is reported that Sri G.R.S. Pal, learned counsel for the appellant, is no more.
Issue notice to the appellant to engage another counsel.
Let the lower court record be summoned within three weeks.
List thereafter."
According to office report, compliance report dated 04.01.2018 submitted by the Chief Judicial Magistrate, Budaun has been received, according to which the appellant-Pappu has left the village 18 years ago and he is not traceable.
Perusal of record reveals that vide order dated 06.09.2010, learned counsel for the appellant was granted a week's time to file leave to appeal.
According to office report dated 12.12.2017, application for leave to appeal has not been received.
In lack of application for leave to appeal, this appeal is not maintainable and it is liable to be dismissed.
Accordingly, the appeal is dismissed. Record be consigned.
