Heard Sri N.N.Tripathi learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 754 of 2017, under Section 302 IPC, P.S. Bar, District Lalitpur, is seeking enlargement on bail during the trial.
There are two accused person, namely, Sukhlal Bunkar and Pappu Bunkar, though the both the accused persons named in the assault but in 161 Cr.P.C. statement of Smt. Sangeeta recorded on 17.09.2017 i.e. on the very next day of the incident, she has attributed the role giving fatal assault to Pappu @ Tejram Bunkar. There is recovery of blood stained axe on his pointing out. I am not inclined to exercise my discretion in favour of the applicant. The bail application of the applicant is hereby rejected.
However considering the peculiar facts and circumstances of the case the trial court is directed to conclude the trial of the applicant within a period of one year from the date of production of certified copy of this order without granting unnecessary adjournments to either of the parties provided the applicant renders fullest cooperation in early disposal of the trial.
