Heard learned counsel for the petitioner, learned Standing Counsel for the State-Respondent Nos.1 & 2 and Sri Kaushlendra Nath Singh for Respondent No.2.
By means of the present writ petition, the petitioner is seeking mandamus directing the respondent authority to decide his representation dated 09.10.2020.
Learned counsel for the petitioner submits that the petitioner is a poor person, running his petty business of street vending to earn his livelihood. He is aggrieved by the action of the respondent authorities to evict him from his respective vending zones. The petitioner prays that he may be protected from eviction in the light of Government Order dated 15.6.2017 issued by Chief Secretary for implementation of Section 3 (3) of 'The Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014' as well as order of this Court dated 1.5.2019 in Writ (C) No. 17004 of 2019 (Rohit Kumar and others Vs. State of UP and others).
It is further prayed that the petitioner has made a representation in this respect on 09.10.2020 and an appropriate direction may be issued to decide the same within a stipulated period.
Sri Kaushlendra Nath Singh, learned counsel appearing on behalf of Development Authority has no objection to the last submission.
No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder.
The writ petition is disposed of with the direction that:
(i) The petitioner shall submit a fresh representation along with the copy of this order within a period of three weeks.
(ii) On the presentation of the same, the competent authority shall take an expeditious decision by passing a reasoned and speaking order in accordance with law, preferably, within a further period of four weeks.
