Heard learned counsel for the petitioners.
The present writ petition has been filed against the order dated 3.5.2019 passed by the Deputy Director of Consolidation, Meerut, i.e., respondent No. 1 (hereinafter referred to as, 'D.D.C.') in Revision No. 114, whereby the D.D.C. has modified the interim order dated 30.11.2018 passed by the Settlement Officer of Consolidation (hereinafter referred to as, 'S.O.C.') in the appeal filed by the petitioners. The order dated 3.5.2019 passed by the D.D.C. is an interlocutory order and does not finally decide the rights of the parties. In his order dated 3.5.2019, the D.D.C. has already held that the sale-deed executed between the parties shall be subject to the decision passed by the S.O.C. in appeal.
There is no illegality in the impugned order dated 3.5.2019 passed by the D.D.C. so as to occasion interference by this Court under Article 226 of the Constitution of India. However, considering the circumstances of the case, it is directed that the S.O.C. shall decide Appeal No. 33/44 within a period of three months from the date a certified copy of this order is produced before him.
With the aforesaid direction, the writ petition is disposed of.
