Heard learned counsel for the applicant, Sri Shyam Singh Yadav, Advocate holding brief of Sri Pranjal Mehrotra, learned counsel for appearing for the Electricity Departyment and learned A.G.A., for the State. Perused the record.
This application U/s 482 Cr.P.C., has been filed to quash the entire proceedings of criminal case no. 8/2006 (State Vs. Pappu Ram) arising out of Case Crime No. 1445 of 2005 under Section 135 Electricity Act, Police Station Gajraula, District J.P. Nagar pending before the First Additional Sessions Judge, Amroha.
Learned counsel for the applicant contended that the applicant has deposited entire penalty amount i.e. Rs. 32,760/- imposed by the Electricity Department.
In view of above, if the applicant files application for compounding of the case, the same shall be decided by the Trial Court by a reasoned and speaking order, preferably within a period of 30 days from the date of receipt of a certified copy of this order.
For a period of 60 days from today or till the disposal of application for compounding the offence, whichever, is earlier, no coercive action shall be taken against the applicant.
With the aforesaid observation, the application U/s 482 Cr.P.C., is disposed of.
