This appeal has been preferred by the appellant- Pappu Khan against the judgment and order dated 21.10.1986 passed by IInd Additional Sessions Judge, Mirzapur, in Sessions Trial No..110 of 1985 (State Vs. Pappoo Khan) under Sections 302/364 IPC, P.S.- Kotwali Katra, District-Mirzapur.
Learned A.G.A. has submitted that as per report of the CJM- Mirzapur dated 2.1.2019, Pappu Khan, the sole appellant in this appeal has died and in view of above, this appeal is liable to be dismissed as abated.
We have heard learned A.G.A. and perused the impugned judgment on record and scanned the lower court record very carefully. The submission made by learned A.G.A. appears to be correct.
From the perusal of the report of CJM, Mirzapur, dated 2.1.2019, it transpires that Pappu Khan, the sole appellant in this appeal had died in the year 1999.
In view of above, this appeal is liable to be dismissed as abated.
The appeal is accordingly dismissed as such.
