1. Heard learned Counsel for the applicant and learned A.G.A.
2. It is alleged that on 5.1.06 when the victim a married lady of 16-17 years had gone to ease. The applicant and co-accused Kuldeep caught hold her, torned her cloth and committed rape upon her. The F.I.R. was initially lodged in offence under Sections 354/504/506/427 I.P.C. and 3(1)(10) SC/ST Act. But after the statement of the victim recorded under Section 164 Cr.P.C. the case was converted into an offence under Section 376 I.P.C. The medical evidence shows that there were dead spermatozoa were found which supports the theory of rape. The victim has narrated the entire occurrence in her statement. There is no ground for bail The bail application is rejected.
