Heard learned counsel for the petitioner and AGA for the State.
The relief sought in this petition is for quashing of the FIR registered at case crime no. 367 of 2009, under Section 147, 148, 149, 307 IPC, P.S. Amanpur, District- Kanshi Ram Nagar.
From perusal of the FIR it appears that on the basis of allegations made therein the cognizable offence is made out. Therefore prayer for quashing the FIR is refused.
The investigation has already been completed by the Investigating Officer and charge sheet has been submitted against four accused. The charge sheet has not been filed against the petitioner, yet he has not been arrested.
Considering all the facts and circumstances of the case, it is directed that in case the petitioner appears before the Magistrate concerned within three weeks from today and applies for bail, the same shall be considered and disposed of expeditiously by the courts below.
With the aforesaid directions, the writ petition is finally disposed of.
