JUDGMENT / ORDER

When the matter was taken up for hearing on 24.03.2017, there was no representation on either side. Hence, the matter was directed to be listed under the caption for dismissal on 21.04.2017, but on that day the matter was not reached. Therefore, the matter was directed to be listed under the same caption on 21.06.2017.
2. The learned counsel appearing for the respondents would submit that the first respondent reported dead but so far they were not able to bring on record the legal heirs of the deceased first respondent.
3. The learned Counsel for the appellant would submit that the appellant is also reported dead. Though the learned counsel appearing for the appellant sent a letter to the appellant, that cover was returned as 'unserved'. He is not able to get any instructions even from the Trial Court Counsel. Subsequently, when the learned counsel appearing for the appellant sent letter to the appellant, there was no response from the legal heirs of the appellant.
4. Therefore, the learned counsel for the appellant is not able to proceed this appeal. Hence, this Second Appeal is dismissed for default.
