JUDGMENT / ORDER

The petitioner has filed this writ petition challenging the auction notice issued by the 2nd respondent herein vide notice dated 26.06.2010 in Ne.Ma.No.1490/03-04 Thava No.28452/02-03 and quash the same.
2. At the time of admission, conditional interim stay has been granted by this Court on 10.08.2010. The learned Additional Government Pleader is not in a position to inform that whether they are complied with the conditional order or not. If they are not complied with as per the conditional order dated 10.08.2010, the interim stay granted by this Court shall stand automatically vacated.
3. The learned Additional Government Pleader would submit that if the petitioner aggrieved by the auction sale notice, he is having alternative remedy under Section 135 of the Tamil Nadu Cooperative Societies Rules, before the Appropriate Authority.
4. In view of the above submissions made by the learned Additional Government Pleader, this writ petition is dismissed as not maintainable with liberty to the petitioner to approach the concerned Authority under Section 135 of the Tamil Nadu Cooperative Societies Rules, before the Appropriate Authority. No costs. Consequently, connected miscellaneous petition is closed.
