JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) TUESDAY, THE SIXTEENTH DAY OF SEPTEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.25405 of 2014 BETWEEN Pannala Sesha Reddy AND ... PETITIONER The State of Andhra Pradesh, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner claims pattadar passbook and title deed with regard to land to an extent of Ac.0-39 guntas in Survey No.197 of Nakrekala Village and Mandal, Nalgonda District. He states that he has made an application in the prescribed proforma followed by representations, dated 23.07.2012 and 19.11.2013. He also states that his mother and brother had already approached this court by filing W.P.Nos.13082 and 17629 of 2013 respectively, seeking pattadar passbooks with regard to their share of the land in the same survey number and the said writ petitions were disposed of on 29.04.2013 and 21.06.2013 directing consideration of the application of the said petitioners and passing appropriate orders within two months. Petitioner, however, says that so far as his land is concerned, his application for grant of pattadar passbook is not being considered.
3. Learned Government Pleader, on instructions, submits that the case of the petitioner’s brother and mother was examined in pursuance of directions of this court in W.P.No.13082 of 2013 as well as another W.P.No.17629 of 2013. It appears that the said applications were rejected on the ground that the land covered therein is not an agricultural land and applicant was not found to be in actual possession. So far as the petitioner is concerned, however, the instructions do not say as to consideration of petitioner’s application for issuance of pattadar passbook.
4. Hence, the writ petition is disposed of directing respondent No.3 to consider the petitioner’s application, as aforesaid, in terms of the A.P. Rights in Land and Pattadar Pasbooks Act, 1971, and pass appropriate orders thereon expeditiously preferably within six weeks from the date of receipt of a copy of the order.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
