The petitioner has preferred the present petition inter-alia with the prayer to direct the District Judge, Mirzapur to decide the reference in respect of the ownership of house No.R97 situated in village Bharpura Pargana Kantit Tehsil Sadar District Mirzapur.
It appears from perusal of the record that National Highways Authorities of India acquired the aforesaid house for road widening but no payment was made to the petitioner on the ground that there is dispute in respect of ownership of the property in question. In this view of the matter vide letter dated 28.12.2019, Special Land Acquisition Officer (Irrigatino) Mirzapur forwarded the matter before the District Judge, Mirzapur.
It is argued that papers and documents have already been placed before the District Judge Mirzapur and the case was also registered as Misc. Case No.100 of 2020. In this view of the matter, a prayer has been made in the present writ petition to direct the District Judge, Mirzapur to decide aforesaid reference at an early date.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of directing the District Judge, Mirzapur to decide the aforesaid reference most expeditiously after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
