Heard learned counsel for the parties.
By the instant petition, petitioners seek the following relief:
"A. Issue a writ, order or direction in the nature of mandamus commanding and directing upon the respondent authorities to execute/implement the order dated 30.06.2016 passed by the Sub- Divisional Magistrate, Sadar, District Jaunpur in Case No. T20161436043160 (Videhi and others versus Gram Sabha) under section 24 of Uttar Pradesh Land Revenue Code;
B. Issue a writ, order or direction in the nature of mandamus commanding and directing upon the respondent authorities to take appropriate legal action against the private respondents for disobeyi8ng the order dated 30.06.2016 passed by the Sub-Divisional Magistrate, Sadar, District Jaunpur in Case No. T20161436043160 (Videhi and others versus Gram Sabha) as well removing the stone pillars fixed by the respondent authorities."
In proceedings under section 24 of the U.P. Revenue Code, 2006, demarcation was carried out by the revenue authorities and stone was fixed on 16.07.2016, however, the stone was immediately removed by the private respondents.
Petitioner seeks re-fixation of the stone.
Learned Standing Counsel submits that the third respondent, Sub- Divisional Magistrate, Sadar, District Jaunpur, shall consider the case of the petitioner in accordance with law.
In view thereof, the writ petition is disposed of directing the third respondent, Sub-Divisional Magistrate, Sadar, District Jaunpur, to consider and decide the application of the petitioner, by a reasoned and speaking order, in accordance with law, expeditiously preferably within three months from the date of receipt of a copy of this order along with a copy of the petition.
It is clarified that the Court has not adjudicated the case of the petitioner on merit.
