Heard learned counsel for the petitioner and Shri Ashish Kumar Srivastava, learned counsel for the Gaon Sabha.
The writ petition has been filed seeking the following reliefs:-
"(I) Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to enter the name of the petitioner in revenue records.
(Ii) Issue a writ, order or direction in the nature of mandamus commanding the respondent authorities to give him the benefit of Section 122-B (4-F) of the U.P Zamindari Abolition and Land Reforms Act, 1950."
In so far so a mandamus for inclusion of the petitioner's name in the revenue record is concerned, this can be done only consequent to an order passed either in a declaratory suit or in proceedings for correction of papers.
Petitioner in case, so advised may avail such of the above remedies for redressal of his grievance.
In so far as relief no. 2 is concerned, this relief, as on date cannot be granted. The benefit of Section 122-B of the U.P.Z.A. & L.R. Act which, as on date, stands repealed, cannot be extended.
Subject to above observations, the writ petition stands dismissed.
