Heard learned counsel for the petitioner, learned Standing Counsel appearing for the State respondent no.1 and Sri Sunil Kumar Dubey, learned counsel appearing for respondent nos.2.
The petitioner has retired on 31.12.2017 after attaining the age of superannuation from the post of Divisional Accountant from the office of respondents.
The grievance of the petitioner is that his post retiral dues including the Leave Encasement, arrears of dearness allowance etc. have not been paid to him by the respondent authorities. The petitioner in this respect submitted several representations to the respondent authority, but no heed was paid, hence, he has approached this Court.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.2 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondents no.2-Managing Director, U.P. Jal Nigam, Lucknow, along with a copy of this order downloaded from the official website of High Court, Allahabad, raising all his grievances within a period of two weeks from today. In case, any such representation is filed by the petitioner, respondent no.2 shall consider and decide the same strictly in accordance with law by a reasoned and speaking order, preferably within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
