Heard Mr. Pradeep Chauhan, learned counsel for the applicant and learned A.G.A. for State.
The first bail application of the applicant was rejected, vide order dated 17.01.2019.
Applicant has now filed second bail application for seeking his enlargement on bail in S.T. No. 100 of 2016, arising out of Case Crime No. 233 of 2015 under Sections 498A, 304B, IPC and 3/4 D.P. Act, P.S. Mehnagar, District Azamgarh during the pendency of the trial.
Learned counsel for applicant submits that a period of more than 10 months has rolled by since the date of passing of order dated 17.01.2019, but the trial itself is proceedings at snail's pace, whereas there was an expectation of the Court in the aforesaid order to gear up the trial and conclude the same within a period of six months from the date of production of a certified copy of the aforesaid order.
Perusal of the order sheet shows that trial has been adjourned on account of non appearance of one of co-accused namely Kadami Devi, who is none else, but mother of the applicant.
In view of above, no good ground is made out for enlarging the applicant on bail. Consequently, second bail application is, hereby, rejected.
