Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Pankaj who is involved in Case Crime No. 595 of 2017, under Sections 392, 411 I.P.C., Police Station-Jalesar, District-Etah.
Learned counsel for the applicant contended that the applicant is not named in the FIR. After 20 days of the occurrence, it is alleged that the stolen 'kundal' has been recovered from his possession. Applicant has been falsely implicated in five other cases. There is no specification of the 'kundal' in the FIR.
Learned A.G.A., has opposed the prayer for bail and contended that there is criminal history of five cases against the applicant.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Pankaj, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
