Heard learned counsel for the petitioners and learned A.G.A for the State.
By means of the present writ petition, the petitioners have invoked extra ordinary jurisdiction of this Court under Article 226 of the Constitution of India praying for quashing the impugned FIR dated 01.12.2018 registered as Case Crime No.798 of 2018, under section 406 I.P.C., Police Station- Kotwali, District- Jhansi.
It is submitted by learned counsel for the petitioner that the dispute between the parties is purely with regard to the money transaction and in case, the matter is refer to the mediation centre then the said matter can be amicably settled before the Mediation Centre of this Court. The petitioners are ready to deposit the requisite amount towards expenses.
Considering the submission made by the learned counsel for the applicants, it is directed that applicants shall deposit Rs. 50,000/- within three weeks from today in the account head of Registrar General, Mediation and Conciliation Centre, Allahabad High Court, Allahabad. In case, the aforesaid amount is deposited the notice shall be issued to opposite party No.4-Vinod Rawat returnable within four weeks. Out of the above mentioned deposited amount, a sum of Rs. 48,000/- shall be paid to the opposite party No.4 and this case shall be sent to Mediation Centre for further proceedings and Rs. 2000/- shall be deposited towards expenses.
After proceedings of the Mediation Centre, list thereafter before appropriate Bench.
Till then no coercive step shall be taken against the applicants in the aforesaid case.
In case the receipt of the aforesaid deposited amount is not filed , the interim order granted to the applicants shall stand automatically vacated.
