Supplementary affidavit has been filed by learned counsel for the petitioner, which is taken on record.
Heard Sri Abhijeet Kumar Pandey, learned counsel for the petitioner, Sri Vijay Raj Pal, learned counsel appearing for all the respondents.
By means of this writ petition, the petitioner has come up before this Court for a direction upon the respondent no.2 to issue passport to the petitioner, which is pending since 17.05.2019 vide Application Reference No.19-0006813102 expeditiously within a stipulated period.
It has been submitted by learned counsel for the petitioner that the petitioner is Regional Manager in Reliance Health Insurance Company and has applied for passport on 17.05.2019 vide Application Reference No.19-0006813102 and the said application is stated to be pending before the respondent no.2.
It has been informed by learned counsel for the petitioner that after applying the passport, a criminal case is stated to be lodged against the petitioner in the year 2017 being Case Crime No.0096 of 2017, under Sections 341 and 353 I.P.C., Police Station Attarsuiya, District Prayagraj.
It has further been informed by learned counsel for the petitioner that petitioner was called by the authority concerned on 21.5.2019 alongwith his documents at Varanasi for verification purpose and despite completing all the formalities, the passport has not been issued to him. It has further been informed that the passport of the petitioner has been sent to Lucknow.
Considering the facts and circumstances of the case but without prejudice to the merits of the case, the respondent no.2 is directed to decide the above said application, in accordance with law, expeditiously preferably within a period of six weeks from the date of production of a certified copy of this order.
The writ petition stands disposed off.
